Disability determination is a process, which starts with the initial claims application being submitted to the Federal Social Security Administration. If all requirements are met, it is forwarded to the state agency where a decision is made to accept or deny the claim. If the initial application is denied, the applicant must apply for reconsideration. A different person reviews all the information submitted during the initial claims application and makes a decision to either award or deny benefits. At this point, a claimant has the right to appeal for a formal hearing with an Administrative Law Judge.
Having a social security lawyer greatly increases the claimant's chances for an accepted claim either at the reconsideration stage or at the hearing before the Administrative Law Judge.
